Switzerland approves first retail spot Bitcoin ETF

2026-10-20 12:53

Switzerland’s Financial Market Supervisory Authority has approved the country’s first retail fund that can hold Bitcoin directly, placing the cryptocurrency inside a Swiss investment-fund structure rather than the debt-based exchange-traded products that have previously dominated the market.

FINMA said the product will be classified as an “other fund for alternative investments” with a specific risk under Swiss law. The classification allows a fund aimed at retail buyers to maintain direct Bitcoin exposure while operating under rules governing fund custody, operations and disclosures.

The regulator did not identify the fund manager or product, and it gave no timetable for a launch or stock-exchange listing. A FINMA spokesperson cited the authority’s policy against commenting on institution-specific cases.

The approval gives Swiss asset managers a route to package spot Bitcoin in a conventional fund wrapper, though buyers will still face the same market volatility attached to the underlying asset. FINMA stressed that its decision does not change Bitcoin’s risk profile and warned that purchasers could lose a substantial part of their capital.

Bitcoin was priced at $81,260.20, down 0.92%, in the market data accompanying FINMA’s announcement.

Finma grants a diversification exemption for bitcoin

Swiss fund rules generally require diversification, a safeguard designed to limit the effect of a sharp decline in one holding. FINMA said it made an exception for Bitcoin after considering the asset’s longer trading history and substantially higher trading volumes compared with most other cryptocurrencies.

That reasoning distinguishes Bitcoin from a fund holding a narrow basket of less liquid tokens. A fund concentrated entirely in Bitcoin carries single-asset risk, but FINMA concluded that Bitcoin’s market depth and established trading activity were sufficient for the exemption under the applicable rules.

The decision applies to Bitcoin rather than cryptocurrencies generally. FINMA’s statement did not indicate that other digital assets would automatically qualify for comparable treatment, leaving prospective issuers to demonstrate that their proposed holdings meet Swiss regulatory standards.

FINMA said other providers have either submitted applications for Bitcoin ETFs or publicly announced plans to do so. That could turn the approval into a test case for how quickly Switzerland’s fund industry can build retail products around direct cryptocurrency holdings while meeting the regulator’s operational requirements.

A fund structure differs from Switzerland’s existing crypto etps

Bitcoin-linked exchange-traded products have been available on Swiss markets for years. In 2019, the SIX Swiss Exchange listed a product offering exposure to both Bitcoin and Ether, and FINMA authorized a cryptocurrency fund for qualified traders in 2021.

Those precedents did not offer the same legal structure as the latest approval. FINMA said existing Swiss Bitcoin ETPs are debt securities, meaning they are notes issued by a financial institution and designed to track the value of an underlying asset. The newly approved vehicle falls under Swiss investment-fund law.

That difference shifts attention toward the controls required of a fund, including how Bitcoin is stored, how access to the assets is governed, how operational failures are handled and how risks are communicated to buyers. Direct holdings also mean the fund manager must establish reliable arrangements for buying, selling and safeguarding Bitcoin rather than relying only on a note issuer’s promise to deliver linked returns.

The regulator’s January guidance addressed those challenges in detail. FINMA said supervised institutions involved in cryptocurrency investments must take steps to mitigate operational and custody risks. Custody is particularly central for a spot Bitcoin fund: control of the private keys that authorize transfers determines control of the assets themselves.

Fund documents must clearly describe the relevant risks, FINMA said. Firms distributing the product must also comply with conduct rules under Switzerland’s Financial Services Act, which covers how financial products are offered to clients.

Launch preparations will depend on custody and distribution controls

The lack of a named issuer leaves several practical questions unanswered. It remains unclear whether the first fund will be listed on an exchange, sold through banks and advisers, or offered through multiple distribution channels. The structure could also affect dealing terms, fees and the mechanism used to create or redeem fund units.

Before a retail product reaches the market, the manager will need to demonstrate that its arrangements meet FINMA’s standards for safeguarding assets and managing operational risks. For Bitcoin funds, those processes can include controls over private-key storage, authorization procedures, transaction monitoring and the ability to value holdings accurately during periods of market stress.

FINMA’s approval does not remove the possibility of sharp Bitcoin price moves. Bitcoin can trade around the clock across global venues, while fund subscriptions, redemptions and valuation processes may follow more conventional financial-market schedules. Clear documentation on pricing, liquidity and trading cut-off arrangements will therefore be particularly relevant to retail buyers.

The regulator’s warning is also likely to shape how the product is marketed. A regulated wrapper can establish disclosure and custody standards, but it cannot shield buyers from Bitcoin’s price movements or guarantee liquidity during a sudden market sell-off.

Switzerland adds another route to regulated bitcoin exposure

Switzerland has long hosted crypto-linked securities, specialist trading activity and products aimed at professional market participants. The new approval extends that framework to a retail fund holding Bitcoin directly, under a category that explicitly recognizes the investment’s elevated risk.

For fund providers, the decision offers a clearer regulatory route than attempting to fit spot Bitcoin into a conventional diversified portfolio product. For retail buyers, it creates a potential alternative to holding Bitcoin directly through a crypto platform or purchasing a debt-based ETP.

The product’s eventual uptake will depend on factors FINMA has not disclosed, including the issuer, fees, distribution network and launch date. Its approval nevertheless establishes that a single-asset spot Bitcoin fund can satisfy Swiss fund rules when its manager meets the required standards for custody, operations and investor disclosure.
