Bitcoin rises above 81000 as Democrats win Senate

2026-11-05 00:50

Democrats secured 51 U.S. Senate seats in the 2026 midterm elections, reaching the threshold for a majority, according to Decision Desk HQ data. The party had won 211 House seats at the time of the count, compared with 119 for Republicans, leaving it seven seats short of the 218 needed to control the chamber.

The Senate result reshapes the immediate legislative setting for cryptocurrency policy, particularly as lawmakers weigh market-structure rules, stablecoin oversight, anti-money-laundering measures, and consumer protections. A Democratic Senate majority would give the party control of committee agendas and confirmation processes, while a House that remains unresolved would limit how quickly either party can advance a comprehensive crypto bill.

Clarity act faces a narrower legislative window

The Digital Chamber said the current version of the CLARITY Act could expire with the end of the 119th Congress on Jan. 3, 2027 if it cannot draw the bipartisan support needed to clear the Senate's 60-vote threshold. The bill is intended to establish a clearer division of regulatory responsibilities for digital-asset markets, an issue that has remained contested between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

The election result does not decide the bill's fate, but it increases the importance of negotiations over its consumer-protection and compliance provisions. The Digital Chamber said a Democratic-led House Financial Services Committee is expected to focus on stablecoin reserve standards, expanded disclosures, tougher anti-money-laundering controls, AI data privacy, and national-security considerations.

Those priorities could produce narrower legislation rather than a single sweeping market-structure package. Stablecoin rules have often attracted more cross-party interest than proposals covering trading platforms, token classifications, and decentralized-finance protocols.

The GENIUS Act, as described in the supplied material, would create a federal framework for payment-stablecoin issuance without removing every state-level licensing obligation for firms handling stablecoins. Exchanges, wallets, payment processors, and remittance companies could still require Financial Crimes Enforcement Network registration as money services businesses and state money-transmitter or virtual-currency licenses, depending on which entity receives, controls, exchanges, or transmits customer value.

That distinction would leave compliance costs tied not only to the type of token a company supports, but also to its exact role in a transaction. A stablecoin issuer, wallet provider, and payments company could face different regulatory obligations even when serving the same customer flow.

Court ruling leaves cftc dispute unresolved

A federal court decision has added another complication to the debate over derivatives oversight. Judge Valerie Caproni of the U.S. District Court for the Southern District of New York denied the Capital Markets Alliance's request for a temporary restraining order in its case involving CFTC-regulated contracts.

The court found that the plaintiffs had not demonstrated imminent irreparable harm, the standard needed for emergency relief. Judge Caproni also said the alliance's argument that the CFTC may have exceeded its authority could succeed, writing that the disputed contracts appeared closer to swaps, which are under SEC oversight, than to security futures.

The ruling did not settle the underlying jurisdictional question. It instead keeps open a dispute with direct implications for platforms that structure products around the border between securities, futures, and swaps. Congressional legislation could reduce such disputes, but the election outcome suggests that any eventual compromise will likely contain more detailed limits on product design and market conduct.

France advances self-custody reporting proposal

France's National Assembly on Nov. 3 adopted an amendment to the country's 2027 finance bill that would require taxpayers to report self-custodied cryptocurrency wallets holding at least EUR100,000 in assets on Dec. 31 of the relevant reporting year.

The measure would apply to wallets not held through a registered crypto-asset service provider and would impose a maximum EUR10,000 fine for non-reporting. The finance bill remains in its first-reading stage, so the amendment has not yet become law.

The proposal targets a part of the crypto economy that traditional financial reporting systems often struggle to capture: assets held directly through personal wallets rather than through centralized intermediaries. Its EUR100,000 threshold would focus the reporting duty on larger holdings rather than everyday retail balances.

South Korea is moving in the opposite direction on timing. Kim Min-seok, leader of the Democratic Party, said he formally proposed delaying the country's cryptocurrency income tax, which is scheduled to take effect on Jan. 1, 2027. The proposal adds to a long-running political debate in South Korea over whether the tax framework is ready and whether domestic platforms and traders have enough certainty over compliance rules.

Network governance proposals target token supply and stolen assets

Several crypto networks are also pursuing changes through governance rather than legislation. NEAR Protocol's House of Stake approved proposal HSP-029 on Nov. 2 with about 99.96% support from 3.29 million veNEAR in voting power.

The plan would lower NEAR's annual issuance cap from 2.5% to 1.6% over 24 months, reducing the rate by an average of 0.0375 percentage points per month. Token distribution would remain unchanged, with 90% directed to staking participants and 10% to the treasury.

The proposal requires approval from the House of Stake Security Council and a roughly 90-day preparation period, including validator upgrades. Its estimates project 11.8 million fewer NEAR issued over the first two years and 66.1 million fewer over six years. Lower issuance would also reduce projected gross staking yield and validator commission revenue if participation remains broadly similar.

Polygon community members have proposed a more interventionist response to stolen funds: a Polygon PoS hard fork that would zero out approximately 70.49 million POL held in blacklisted attacker addresses and send the tokens to a recovery address. The proposal valued the tokens at roughly USD6.5 million on Oct. 29 while maintaining the network's total supply.

The suggested recovery includes about 23.86 million POL associated with Polymarket-related addresses and 46.63 million linked to Binance-related addresses. The proposal was scheduled for discussion during a protocol governance call on Nov. 5, with the activation block and client version yet to be determined.

These governance debates show how protocol communities are increasingly dealing with issues usually associated with financial regulation: supply policy, recovery mechanisms, asset control, and the treatment of illicitly obtained tokens. In the United States, the new Senate majority will face related questions at the federal level, where the challenge is less about changing one network's rules and more about setting standards that can apply across an industry built from many of them.
