We do not represent or warrant that the DEX+ trading service is suitable for your financial situation or investment objectives. Access to Toobit DEX+ may be restricted in certain jurisdictions.
1.2 Inherent risks of DEX+ Trading
Toobit DEX+ facilitates interaction with external, third-party decentralized protocols and smart contracts over which we have no control. Toobit does not conduct due diligence, security audits, or formal reviews of these third-party protocols. The availability of a protocol through Toobit DEX+ thus does not constitute an endorsement, guarantee, or warranty of its legitimacy, security, or functionality. Third-party protocols are subject to inherent risks, including hacking, smart contract vulnerabilities, exploitation, flawed economic models, or complete failure. Since we do not custody your assets or control the underlying protocols, your interaction with them is entirely at your own risk and may result in the partial or total loss of your invested assets.
1.3 Return and volatility disclaimer
Toobit does not promise or guarantee any investment returns. The value of digital assets is highly volatile and can fluctuate dramatically in a short period, potentially leading to the complete loss of your initial investment. Assets available through DEX+ may have higher-than-average volatility that can impact your trading outcomes.
1.4 Investment responsibility
You are solely responsible for all decisions, orders, and transactions made on your account. It is your exclusive responsibility to perform an independent assessment and determine the suitability of any transaction you undertake. For this reason, we strongly recommend that you seek independent counsel from a qualified financial advisor to assess your personal financial situation and risk tolerance before engaging in any DEX+ trading activity.
1.5 Listing clarification
Assets available through DEX+ are frequently innovative, experimental, and may possess low market capitalization and limited liquidity. As such, the inclusion of an asset in Toobit DEX+ should not be misinterpreted as an endorsement. It does not imply that the asset has met the more stringent listing requirements for our primary Spot or derivatives markets. Assets available through DEX+ may experience higher-than-average volatility, an increased potential for significant price slippage on trades, and higher associated network transaction fees (gas fees) that can impact your trading outcomes.
2. Scope of Terms
- These Terms govern your access to and use of the DEX+ trading service and any related services.
- By accessing or using the DEX+ service, you agree to be bound by these Terms, which may be updated periodically.
- We reserve the right to modify, update, or replace any part of these Terms (“Revised Terms”) at our sole discretion. When we make significant changes to these Terms, we will endeavour to provide you with reasonable notice, which may include notification via email to the address associated with your Toobit account, prominent in-app announcements, or other reasonable means. All Revised Terms will be effective immediately upon their posting on our platform or upon notification to you, whichever occurs first. Your continued use of the DEX+ service after any changes constitutes your acceptance of the Revised Terms.
3. Definitions
- DEX+ Trading assets: Any digital asset, token, or cryptocurrency that is made accessible for trading through the DEX+ service on Toobit.
- DEX+ Trading account: The dedicated account where users can view and manage their DEX+ assets.
- DEX+ quote: A non-binding, indicative price for a potential asset conversion, provided through the DEX+ service for informational purposes. A DEX+ quote is subject to change based on market conditions until a Trade Request is executed.
- Trading parameters: The specific variables confirmed by the User prior to execution, which may include the target price, acceptable slippage tolerance, transaction fees, and network gas fees required to process a DEX+ transaction.
- Trade request: A User's formal and irrevocable instruction to the Dex+ service to attempt the execution of a transaction based on a confirmed DEX+ quote and agreed-upon Trading Parameters.
4. Eligibility and regional restrictions
- Users must meet the eligibility criteria outlined in the Toobit User Agreement and these Terms.
- The DEX+ service may be restricted in certain jurisdictions due to legal and compliance requirements.
5. DEX+ service specifications
5.1 Asset availability
The DEX+ service may display prices, charts, and other market information related to DEX+ assets. The display of such information shall not be construed as an endorsement, a recommendation to transact, or any form of financial or investment advice from Toobit.
5.2 Asset buying and selling
- DEX+ quotes: We may provide non-binding, indicative quotes.
- Purchase conditions: You can only use accepted stablecoins or other approved digital assets[K1] for purchases.
- Trading parameters: Transactions prioritize execution speed over cost, which may lead to slippage or higher fees. The final execution prices are based on the current best available on-chain price.
- Trade requests: Once confirmed, trade requests are irrevocable. Toobit reserves the right to accept or reject any trade request.
5.3 Execution and settlement
The process for DEX+ transactions includes asset locking, specific settlement mechanics, and procedures for handling failed transactions.
5.4 Asset management
You can only access and manage your DEX+ assets through your DEX+ trading account.
5.5 Transaction gistory
You can view your DEX+ trade records within your trading account.
6. Fees and ttax responsibilities
- Transactions are subject to trading fees and blockchain gas fees, which will be specified during order execution.
- You are solely responsible for any tax obligations arising from your use of the DEX+ service.
7. Disclaimer and limitation of liability
- Toobit makes no guarantees regarding the price, performance, or successful execution of DEX+ asset transactions.
- Toobit will not be liable for any direct or indirect losses you may incur from DEX+ asset trading.
- You bear full responsibility for understanding all related risks and for all your investment decisions.
- You acknowledge that the regulatory landscape governing digital assets and decentralized finance is rapidly evolving and subject to frequent changes. Toobit reserves the right to suspend or terminate your access to the DEX+ service at any time for reasons including, but not limited to, legal compliance, security concerns, operational needs, or violations of these Terms.
8. User acknowledgements
By using the DEX+ trading service, you explicitly acknowledge and agree that:
- You understand and voluntarily assume all associated risks.
- You are solely responsible for assessing the suitability of the DEX+ service in light of your financial condition and investment objectives.
- You do not rely on Toobit to guarantee or endorse the performance or outcome of any asset or transaction.
9. Privacy policy
Your use of the DEX+ service is also governed by Toobit's Privacy Policy. By accessing or using the DEX+ service, you acknowledge that you have read, understood, and agree to the terms of Toobit’s Privacy Policy regarding the collection, use, and sharing of your personal data and information.
