Senate blocks crypto Clarity Act over Trump ethics

The U.S. Senate failed to advance the Clarity Act on Tuesday after the cryptocurrency market-structure bill fell short of the 60 votes required to clear a procedural hurdle, with Democratic concerns over President Donald Trump’s personal crypto holdings emerging as a decisive obstacle.

The vote stalled a proposal that its Republican sponsors have described as a comprehensive federal framework for digital-asset markets. Several Democrats viewed as possible supporters — Kirsten Gillibrand of New York, Catherine Cortez Masto of Nevada, Angela Alsobrooks of Maryland, Cory Booker of New Jersey, and Mark Warner of Virginia — voted against moving the measure forward.

Warner said after the vote that he could not support legislation that, in his view, could permit a president to personally profit from the cryptocurrency sector. He said negotiators had made progress on provisions involving law enforcement and national security, but unresolved conflicts-of-interest questions prevented him from backing the procedural step.

The impasse leaves a major crypto bill caught between bipartisan interest in clearer rules and a political dispute that reaches beyond the industry’s usual battles over securities law, market oversight, and stablecoins.

Ethics dispute blocks a market-structure bill

Senator Cynthia Lummis, the Wyoming Republican leading the legislation, urged colleagues to support the bill before the cloture vote. The Clarity Act is intended to establish federal rules defining how digital-asset businesses, trading platforms, and related products would be regulated.

Its backers argue that statutory rules would give companies and regulators more certainty than the current system, in which agencies and courts have often determined the boundaries of oversight case by case. A Senate setback does not end that debate, but it shows that a deal on technical market rules may not be enough when lawmakers remain divided over how such rules would apply to public officials with large crypto-related financial interests.

Trump’s digital-asset wealth has become a prominent point of contention. His reported connections to World Liberty Financial and the TRUMP memecoin have given Democrats a concrete example to raise during negotiations over ethics provisions.

Republicans circulated revised draft language before Tuesday’s vote that added provisions concerning “non-decentralized finance protocols,” a category intended to address financial arrangements that may use blockchain infrastructure while retaining identifiable operators or centralized control. The change sought to respond to concerns that certain businesses could avoid compliance requirements simply by describing themselves as decentralized.

The revisions left the ethics provisions largely intact, according to the material provided. They would allow state attorneys general to bring cases against cryptocurrency exchanges, while the Justice Department would be responsible for enforcing the bill’s ethics rules.

The draft also would require public officials to divest relevant financial interests or place them in blind trusts. Democrats argued that a blind-trust option would not adequately address a president’s crypto exposure, particularly if enforcement ultimately depended on the Justice Department deciding whether to pursue a case involving the president.

Democrats sought tougher limits on family holdings

Senate Democrats prepared a counterproposal Monday night that would have expanded the restrictions to include Trump’s crypto interests and those held by his children. Their proposal would also have required officials with what it described as a very large interest in a crypto company to sell that interest rather than transfer it into a blind trust.

Lummis rejected the counteroffer, leaving no compromise in place before the Senate vote.

That disagreement illustrates the difficulty of separating a market-structure bill from the financial interests of the administration that would oversee its implementation. Democrats have treated the ethics language as a condition for supporting a framework that could shape oversight of platforms, tokens, and crypto financial products. Republicans have pursued a narrower approach focused on disclosure, divestment, trusts, and enforcement mechanisms.

The dispute also adds a new source of uncertainty for companies seeking federal legislation. Banks and crypto firms have already contested parts of the bill involving stablecoins, while lawmakers have pressed for stronger measures addressing illicit finance, consumer harm, and national-security risks. The ethics fight has now become another issue requiring resolution before a Senate coalition can reach 60 votes.

Agencies continue work without a statute

The legislative delay does not stop U.S. financial regulators from acting under their existing authority. The Securities and Exchange Commission and the Commodity Futures Trading Commission have continued to move forward with policy and rulemaking efforts while Congress debates whether to set a broader statutory framework.

SEC Chair Paul Atkins said Monday that Congress should advance the Clarity Act, while adding that the agency would proceed with its own work regardless of the bill’s outcome. Atkins made the remarks during an event hosted by the Solana Policy Institute.

That parallel approach means the industry is likely to face a mix of agency action, enforcement decisions, and court interpretation while lawmakers negotiate. A congressional law could potentially draw clearer lines between SEC and CFTC responsibilities, but Tuesday’s result leaves those boundaries unsettled for now.

Narrow calendar complicates another vote

Senate leaders could bring the legislation back for another procedural vote if negotiations produce enough support and floor time becomes available. The immediate path is unclear, with Congress facing a compressed schedule before the November midterm elections and lawmakers preparing to leave Washington for recess and campaigning.

Even if the Senate were eventually to pass the measure, the House would still need to take it up. The House’s cancellation of its final two weeks of September makes a pre-election vote less likely, based on the current congressional calendar.

The failed cloture vote places the Clarity Act in a familiar congressional position: technically alive but politically stalled. Any renewed effort will likely require an agreement that addresses both the crypto industry’s demand for clearer federal rules and Democrats’ insistence that those rules cannot leave presidential crypto holdings subject to uncertain enforcement.
